The text below is the full and binding agreement.
1. PARTIES
These Terms of Service ("Agreement") are entered into between SilaWay ("Service Provider") and the natural person using the App ("User").
By installing or using the App you confirm that you have read, understood, and accepted this Agreement.
2. SERVICE DESCRIPTION
The App provides services including border crossing wait time estimates, maps and directions, weather, fuel price information, live camera streams (sourced from third parties), and community chat.
A significant portion of the information is compiled from user contributions, open data sources, and third-party APIs. **The information is for informational purposes only and is not an official source.** Do not base your driving and travel decisions solely on this App; confirm with the relevant customs office and official authorities.
3. AGE RESTRICTION
You must be at least **16 years of age** to use the App. Users under 16 must not use the App.
4. ACCOUNT AND SECURITY
• You are responsible for the security of your account. If you suspect unauthorised use of your password or session, please notify [email protected] immediately.
• Guest and registered users are subject to different features and limits.
• Creating fake accounts, impersonating others, using automated bots, or selling/transferring accounts commercially is prohibited.
• Accounts created with Apple's "Private Email Relay" are **not considered fake**; this is an official Apple privacy feature.
5. ACCEPTABLE USE
You may not use the App to:
• Share illegal, harassing, hateful, discriminatory, or sexually exploitative content
• Send spam, persistent or unwanted messages to other users
• Bypass the App's security measures, send large amounts of automated requests, or misuse third-party APIs through the App
• Submit **intentionally misleading** reports (e.g. fake border wait times)
• Reverse engineer the App outside the scope of EU Software Directive 2009/24/EC Articles 5-6, or attempt unauthorised access to the source code
Violations may result in your account being suspended or, depending on severity, terminated **without prior notice**. You may appeal a termination decision via [email protected].
6. USER CONTENT
You retain ownership of content (messages, images) you post in chat and other user-visible areas. However, you grant SilaWay a **non-exclusive, royalty-free, worldwide, sub-licensable license** to display, store, and transmit that content within the App. This license survives account deletion to the extent that copies may remain on other users' devices.
Content that violates community rules will be removed following user reports or moderation.
**ZERO TOLERANCE FOR OBJECTIONABLE CONTENT:** SilaWay enforces a **zero-tolerance** policy toward objectionable or abusive content and abusive users. Every user can **report (flag)** any message in chat and **block** other users — a blocked user's content is instantly removed from your feed and the developer is notified. Reported objectionable content is reviewed **within 24 hours**; if a violation is found, the content is removed and the user who posted it is ejected from the app (account suspended/terminated).
7. PAID FEATURES
• In this version, **all features of the app are FREE**; there is **no** paid package, subscription, or in-app purchase. If a paid feature is introduced in the future, the pricing, purchase, and refund terms will be shown clearly at the time of purchase and these Terms will be updated.
8. APPLE-SPECIFIC TERMS (Apple App Store users)
If you obtained the App through the Apple App Store, the following terms also apply:
(a) This Agreement is between SilaWay and the User only; Apple Inc. is not a party.
(b) Maintenance and support of the App are solely the responsibility of SilaWay; Apple has no obligation to provide them.
(c) Any failure of the App to conform to any warranty is the sole responsibility of SilaWay; Apple provides no warranty.
(d) Claims by third parties relating to intellectual property of the App are addressed by SilaWay; Apple is not responsible.
(e) Apple Inc. and its subsidiaries are **third-party beneficiaries** of this Agreement, and may enforce the Agreement directly against the User upon breach.
9. LIMITATION OF LIABILITY
(a) The App is provided "AS IS" and "AS AVAILABLE". SilaWay makes no express or implied warranties that the App will be uninterrupted, error-free, or fit for a particular purpose.
(b) Border wait times, weather, fuel prices, map data, and AI outputs are **estimates for informational purposes only and do not constitute an official source**. SilaWay is not liable for damages resulting from decisions based on this information.
(c) To the maximum extent permitted by law, SilaWay is not liable for indirect, incidental, special, punitive, or consequential damages. Mandatory consumer rights remain reserved.
10. TERMINATION
(a) You may terminate your account at any time from within the App ("Delete Account").
(b) SilaWay reserves the right to terminate your account for breach of this Agreement. Except for serious breaches (e.g. illegal content), reasonable prior notice will be given before suspension where practical.
11. FORCE MAJEURE
SilaWay is not in breach of this Agreement if service is temporarily unavailable due to circumstances reasonably outside its control, including natural disasters, war, pandemic, internet infrastructure outages, or third-party service (Firebase, DeepSeek, AMSS, etc.) interruptions.
12. SEVERABILITY
If any provision of this Agreement is found invalid by a competent court, the remaining provisions continue in full force and effect.
13. GOVERNING LAW AND JURISDICTION
(a) This Agreement is governed by the **laws of the Republic of Türkiye**.
(b) For consumers residing in Turkey: under Consumer Protection Law Art. 73, consumer disputes may be resolved at the **consumer arbitration board or consumer court of your place of residence**.
(c) For consumers residing in EU Member States: mandatory provisions of your country's consumer protection law under EU Directive 2011/83/EU remain reserved.
(d) For non-consumer users, the courts of Istanbul shall have jurisdiction.
14. ENTIRE AGREEMENT AND CHANGES
This Agreement together with the Privacy Policy constitutes the entire agreement between the parties. SilaWay reserves the right to amend the Agreement; significant changes will be announced via in-app notification or email. Continued use of the App after such notice constitutes acceptance of the changes.
